Can I complain if my company delay in paying variable bonus or AWS?
The company can choose any date to pay the employee AWS or variable bonus. There is no dateline specified in the Employment Act when the employer shall pay the AWS and bonus, and in fact, AWS and bonus are not mandatory.
Hence, in my opinion, Ministry of Manpower will not take in cases when the AWS or bonus being delayed, as long as the monthly salary is paid before 7th of the following month.
However, if the date was specified in the employment contract, and the employer failed to comply to the date, I guess the employee can file civil suit to claim the said amount.
