Annual Leave Entitlement

What should be the actual number of days of leaves for employees who had worked for the company for more than 3 months whom had just started his employment with the company in August 2009? And the number of days of leaves for employees who had worked for the company for more than a year?
Based on Employment Act, 7 days annual leave is a minimum per year with increment of 1 per year until the max of 14 days.
As per your case, the one who joined in August 2009 shall entitled to 3 days annual leave in 2009.


If an employee has used up his/her leave entitlement for that year, how should we calculate the number days of leaves for him /her in the next year?
If employee has used up the leave entitlement for the year, he shall apply for unpaid leave. It is not encourage for company to grant advance leave, as employer may have difficulty to recover back the leave upon employee resignation or termination.


If let’s say we give encouragement to staff who did not use their leave by encashing all their leaves balance (i.e: annual leaves for year 2009 is 0 day), so for the next year, how should we
calculate the number of days of leaves for him / her?
The number of days of leave is depends on the number of year of service. As per employment act, 7 days a minimum with increment of 1 day per year.


For instance if the staff has worked for a year and the leave entitlement for him/her is 7 days and that the company has given the staff back in money form for the 7 days, so for the following year, if let’s say the staff did not take any leave, so how much should the leave entitlement for him/her be and how much should we encash back to him / her if no leave is consumed for the following year?
